This Privacy Policy explains how WerkVisor Measure is operated and how personal data is collected, used, stored, disclosed, and otherwise processed when you use the WerkVisor website, web application, and mobile applications for Android and iOS (together, the "Service").

1. Who We Are

WerkVisor Measure is operated by Dzmitry Yavid, an individual software developer ("WerkVisor", "we", "us", or "our").

2. Scope of This Privacy Policy

This Privacy Policy applies to personal data processed through:

  • the WerkVisor website and landing pages
  • the WerkVisor Measure web application
  • the WerkVisor Measure Android application
  • the WerkVisor Measure iOS application
  • related support, communications, and account management activities This Privacy Policy does not apply to third-party websites, services, or applications that may be linked from or integrated with the Service, except as expressly described here.

3. Our Role: Controller and Processor

Depending on the context, we may act in different privacy roles.

3.1 When we act as a controller

We act as a data controller for personal data that we use to operate and administer the Service, including, for example:

  • account registration and authentication data
  • website and service administration data
  • support communications
  • billing and business contact data
  • service security, fraud prevention, and technical logs

3.2 When we act as a processor or service provider

We generally act as a data processor or service provider for customer content uploaded, recorded, stored, or managed in the Service on behalf of a business customer, consultant, or organization, including:

  • video and audio recordings
  • annotations, measurements, timestamps, and workflow labels
  • project files and workspace content
  • any personal data included in customer content In these cases, the relevant customer or organization typically decides why the data is collected, whose data is involved, how the Service is used in their environment, and what legal basis applies. That customer or organization is typically the data controller for such content.

4. Business Use Only

WerkVisor Measure is intended for professional and business use only by users aged 18 and over. The Service is not intended for consumer social sharing, public community posting, or children's use.

5. Categories of Personal Data We Process

Depending on how the Service is used, we may process the following categories of personal data.

5.1 Account and identity data

  • company name
  • role or job title
  • login credentials or authentication identifiers
  • account preferences and workspace membership

5.2 Customer content

  • video recordings
  • audio recordings
  • uploaded media files
  • annotations, measurements, time studies, comments, labels, and related metadata
  • still frames or previews generated from video for display within the Service
  • project names, process step names, and workspace information

5.3 Device and usage data

  • device type

  • app version
  • browser type
  • IP address

  • crash diagnostics
  • performance logs
  • technical event logs
  • security-related logs

5.4 Communications and support data

  • support requests
  • contact form submissions
  • emails and attachments sent to us

7. How We Use Personal Data

We may use personal data for the following purposes:

  • to provide, maintain, and improve the Service
  • to create and manage accounts and workspaces
  • to authenticate users and manage access rights
  • to store, display, process, and organize customer content
  • to enable workflow measurement, annotation, and time-study functionality
  • to provide customer support
  • to monitor performance, reliability, and security of the Service
  • to detect, investigate, and prevent fraud, abuse, or unauthorized use
  • to communicate with users about service-related matters
  • to comply with legal obligations
  • to protect our rights, safety, property, and users We do not currently use customer content to train general-purpose AI or machine learning models. We do not currently sell personal data, use advertising SDKs, or share customer content with third-party AI providers for analysis.

8. Legal Bases for Processing

Where GDPR or similar laws apply, we process personal data on one or more of the following legal bases:

  • performance of a contract, where processing is necessary to provide the Service
  • legitimate interests, such as maintaining security, preventing abuse, operating the Service, and supporting users
  • legal obligation, where we are required to retain or disclose data under applicable law
  • consent, where consent is required, such as certain device permissions or non-essential tracking technologies if later used
  • customer instructions, where we process customer content on behalf of a business customer acting as controller

9. Recording and Uploading Content

WerkVisor Measure is a professional tool for recording, uploading, organizing, and analyzing work-related process content. By using recording or upload features, you represent and acknowledge that:

  • you have the right and authority to record, upload, and process the content
  • your use of the Service does not violate applicable law, workplace rules, contractual restrictions, confidentiality obligations, or site-specific recording restrictions
  • you are responsible for obtaining any notices, permissions, authorizations, approvals, or other legal bases required in your environment
  • if your content includes employees, contractors, visitors, or other third parties, your organization is responsible for ensuring lawful processing of their personal data You must not use the Service for:
  • covert or unlawful surveillance
  • unauthorized audio or video recording
  • facial recognition or biometric identification
  • secret monitoring in violation of law or workplace rules
  • unlawful discrimination, hidden employee surveillance, or solely automated decisions with legal or similarly significant effects on individuals
  • recording in areas where photography, videography, or audio capture is prohibited

10. Faces, Voices, and Third Parties in Content

Customer content may include the image, voice, or behavior of workers, contractors, visitors, or other individuals. WerkVisor does not decide who your organization records or why that recording takes place. If you use the Service in workplaces, client sites, factories, warehouses, laboratories, schools, healthcare environments, airports, public-sector facilities, or other regulated or restricted settings, your organization is responsible for determining whether recording is lawful and whether additional notices, approvals, signage, or safeguards are required. If you are an individual who believes your personal data appears in content uploaded by one of our customers, you should first contact the relevant customer or organization directly, as that organization may be the controller for that content.

11. Features We Do Not Currently Provide

As of the effective date of this Privacy Policy, WerkVisor Measure does not currently provide:

  • facial recognition
  • biometric identification
  • re-identification of individuals across recordings
  • automated productivity scoring of identified individuals
  • AI-based speech-to-text or AI summary features for customer content
  • third-party AI processing of customer content
  • public social sharing features
  • advertising-based tracking If these features are introduced in the future, we may update this Privacy Policy and, where required, provide additional disclosures, controls, or consent mechanisms.

12. Device Permissions

Depending on your device, platform, and the features you use, the mobile application may request access to:

  • Camera - to record video
  • Microphone - to record audio
  • Photos, videos, or files - to upload existing content, preferably through platform-provided pickers where available
  • Notifications - to send service-related notifications, processing status, invitations, or operational updates You can manage these permissions in your device settings. If you deny or revoke certain permissions, parts of the Service may not function properly.

13. Cookies and Similar Technologies

The website and web application may use strictly necessary cookies and similar technologies needed to provide core functionality such as authentication, session management, security, and basic service operation. If we later use non-essential analytics, marketing cookies, or similar tracking technologies, we will update this Privacy Policy and request consent where required by applicable law.

14. How We Share Personal Data

We may share personal data only as reasonably necessary for the purposes described in this Privacy Policy.

14.1 Service providers and infrastructure providers

We may share personal data with vendors that help us operate the Service, such as providers of:

  • cloud hosting
  • cloud storage
  • content delivery or infrastructure support
  • authentication services

  • email delivery
  • security monitoring
  • backup and recovery services These providers are only permitted to process personal data on our behalf under appropriate contractual and security obligations.

14.2 Business customers and authorized users

Customer content may be accessible to the workspace owner, administrators, and other users authorized by the relevant customer organization.

14.3 Legal and compliance disclosures

We may disclose personal data where required to do so by law or where reasonably necessary to:

  • comply with legal process
  • respond to lawful requests by public authorities
  • enforce our terms
  • investigate fraud, abuse, or security incidents
  • protect rights, safety, and property

14.4 Business transfers

If we are involved in a merger, sale, transfer of assets, financing, acquisition, or similar transaction, personal data may be transferred as part of that transaction, subject to appropriate safeguards.

15. International Data Transfers

At the time of this Privacy Policy, we intend to keep Service data hosted in the EU/EEA. If we later transfer personal data outside the EU/EEA or other regions with transfer restrictions, we will use lawful transfer mechanisms as required by applicable law, such as contractual safeguards or other valid transfer mechanisms.

16. Data Retention

We retain personal data only for as long as reasonably necessary for the purposes described in this Privacy Policy, unless a longer retention period is required by law, contract, or legitimate security needs. Before publishing, replace the bracketed periods below with your real periods. Unless customer-specific terms state otherwise, we currently intend the following baseline retention approach:

  • account data: for as long as the account remains active and for a reasonable period thereafter to handle security, support, and legal obligations
  • customer content: until deleted by the user, customer administrator, or under workspace retention rules
  • deleted files in recoverable state or trash: up to [30 days]
  • application and technical logs: up to [90 days]
  • security logs: up to [180 days]
  • backups: up to [30 days] after creation, after which they are overwritten or deleted We may retain certain data for longer where necessary for fraud prevention, dispute resolution, legal compliance, or enforcement of agreements.

17. Data Deletion and Account Deletion

If you have an account with WerkVisor Measure, you may request deletion of your account and associated personal data through: the in-app path: [Settings > Account > Delete Account]; and/or the web deletion request page: [ACCOUNT DELETION PAGE OR FORM]. Deleting an account does not always mean that every item of data is erased immediately. Some data may be retained for a limited period where required for security, fraud prevention, legal compliance, dispute handling, backup rotation, or to complete a deletion workflow. If you are using the Service through an organization, your organization may also control deletion of workspace data and content.

18. Security Measures

We use reasonable technical and organizational measures designed to protect personal data against unauthorized access, loss, misuse, alteration, and unlawful disclosure. These measures may include:

  • encryption in transit
  • access controls
  • role-based permissions
  • logging and monitoring
  • backup and recovery controls
  • infrastructure security measures No method of transmission or storage is completely secure, but we work to protect the Service and personal data in a manner appropriate to the risks involved.

Depending on your location and applicable law, you may have rights including:

20. Additional Information for EEA, UK, and Similar Jurisdictions

If you are located in the EEA, UK, or a jurisdiction with similar privacy laws:

  • you may have the rights listed in Section 19
  • our legal bases are described in Section 8
  • if we act only as a processor for customer content, the relevant customer is typically the primary contact for rights requests relating to that content
  • if cross-border transfers occur in the future, we will rely on lawful transfer mechanisms where required

21. Additional Information for U.S. State Privacy Laws

Depending on your state of residence and applicable law, you may have certain rights regarding personal information, such as the right to:

  • know the categories of personal information collected
  • access or obtain a copy of your personal information
  • request correction or deletion
  • appeal a denied privacy request where required by law WerkVisor Measure does not currently sell personal information, use advertising-based cross-context behavioral tracking, or provide public consumer profiles. If future features or business practices change in a way that affects these statements, we will update this Privacy Policy.

22. Children's Privacy

WerkVisor Measure is not directed to children and is intended only for business users aged 18 and over. We do not knowingly provide the Service for children's use as part of its intended purpose. If you believe that personal data relating to a child has been submitted to us inappropriately, please contact us so that we can review and take appropriate action.

23. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. When we do, we will post the updated version on the relevant website or within the Service and update the "Last updated" date above. Where required by law, we may also provide additional notice.
